1. About NVOX

NVOX provides a technology enabled, clinician reviewed assessment platform designed to support structured evaluation of ADHD, learning related difficulties, and related clinical or educational questions.

NVOX may provide information about assessment workflows, clinical review, AI assisted decision support, report related services, clinician involvement, NVOX Companion, educational resources, and related services.

The public website is intended to provide general information about NVOX, its services, its approach, and how users may begin or learn about the assessment process.

2. Relationship to Platform Terms

These Website Terms apply only to use of the public website and related public content.

Use of the NVOX platform, assessment workflow, intake forms, account areas, payment pages, clinician review process, report generation process, NVOX Companion, video or audio based assessment tools, collateral forms, secure uploads, scheduling tools, or any paid or clinical service may be governed by additional terms, notices, consents, privacy documents, and point of use disclosures.

If you create an account, begin an assessment, submit clinical or educational information, make a payment, schedule a clinician session, use NVOX Companion, or receive a diagnostic support report, you may be required to accept the applicable NVOX Platform Terms of Use and related notices.

In the event of a conflict between these Website Terms and the NVOX Platform Terms of Use, the Platform Terms of Use will control with respect to platform services, assessments, reports, clinical workflows, Protected Health Information, data handling, clinician review, NVOX Companion, and paid services.

3. No Medical, Psychological, Legal, or Emergency Advice

The content on this website is provided for general informational and educational purposes only.

The website does not provide medical advice, psychological advice, psychiatric advice, legal advice, educational placement advice, school advocacy advice, emergency support, crisis intervention, psychotherapy, prescription services, or ongoing clinical treatment.

Use of this website does not create a physician patient, therapist patient, psychologist patient, clinician patient, attorney client, or similar professional relationship.

You should consult a qualified professional before making decisions about diagnosis, treatment, medication, school accommodations, employment accommodations, legal rights, educational placement, testing accommodations, or other significant matters.

4. Assessment Services and Human Review

NVOX describes its assessment services as technology enabled and clinician reviewed. AI assisted components, structured tools, questionnaires, performance tasks, behavioral indicators, and related analytical outputs are used to support professional review.

AI assisted components do not independently diagnose, prescribe treatment, determine eligibility for accommodations, or replace licensed professional judgment.

No final diagnostic support report is issued through the NVOX platform without review and approval by a licensed clinician, subject to the applicable Platform Terms of Use and clinical workflow.

Unless expressly stated in writing, NVOX does not represent that its platform is cleared, approved, certified, or endorsed by the FDA or by any other governmental authority.

5. No Guarantee of Diagnosis or Third Party Acceptance

NVOX does not guarantee any particular diagnosis, clinical conclusion, school outcome, accommodation approval, employment outcome, testing accommodation approval, insurance decision, legal outcome, licensing decision, or institutional acceptance.

Any diagnostic support report, platform output, website content, or NVOX Companion output is subject to professional interpretation and may not satisfy the requirements of every school, employer, testing organization, licensing body, insurer, governmental agency, court, or other third party.

Users are responsible for checking the requirements of any school, employer, testing body, licensing body, insurer, or other institution before purchasing or using NVOX services.

6. Eligibility and Use by Minors

The website is intended for users who have legal capacity to use it and to submit information.

If information is submitted regarding a person under eighteen years of age, the submission must be made or authorized by a parent or legal guardian with legal authority to do so.

Where applicable law requires direct parental notice or verifiable parental consent before collecting personal information from a child under thirteen years of age, NVOX will require such notice and consent before collection from the child.

By submitting information on behalf of a minor, you represent that you have the legal authority to do so and that the information submitted is accurate and not misleading.

8. Communications

By providing contact information to NVOX, starting a registration, submitting a form, booking a call, beginning an intake process, requesting information, or initiating a payment or service process, you agree that NVOX may contact you using the contact information you provided.

These communications may include service related emails, SMS messages, phone calls, account notices, scheduling communications, payment reminders, security notices, support messages, follow up regarding incomplete registration or payment steps, and responses to your inquiries.

Where NVOX sends marketing, promotional, or informational communications, NVOX will comply with applicable consent and opt out requirements.

NVOX will not use automated telemarketing calls, prerecorded calls, artificial voice calls, or regulated promotional text messages where prior express written consent is required and has not been obtained.

You may opt out of nonessential marketing communications where required by law or where an opt out method is provided. Service related, security related, transactional, legal, or administrative communications may still be sent where necessary.

9. Privacy and Data Handling

Use of this website is subject to the NVOX Website Privacy Policy and any privacy notice linked from the website.

NVOX does not knowingly collect personal information online from children under thirteen through the public website without legally required parental coUse of the NVOX platform, assessment services, clinician reviewed workflows, NVOX Companion, secure uploads, diagnostic reports, and related clinical services may also be governed by additional privacy documents, including the NVOX Platform Privacy Policy, Notice of Privacy Practices, Washington Consumer Health Data Privacy Policy where applicable, AI governance notices, consent forms, and other compliance documents.nsent.

If there is a conflict regarding the handling of Protected Health Information subject to HIPAA, the applicable Notice of Privacy Practices will control.

If there is a conflict regarding non PHI personal information, the applicable Privacy Policy will control.

NVOX does not sell, rent, trade, or monetize personal information or Protected Health Information.

10. Intellectual Property

The website, platform, text, graphics, designs, logos, icons, videos, images, software, user interface elements, report structures, sample report materials, educational materials, methodology descriptions, templates, visualizations, compilations, and other content are owned by NVOX INC or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.

Subject to these Terms, NVOX grants you a limited, revocable, nonexclusive, nontransferable permission to access and use the public website for personal, informational, and lawful purposes.

You may not copy, reproduce, scrape, mine, extract, modify, translate, adapt, publicly display, distribute, sell, license, commercialize, reverse engineer, benchmark, train models on, create datasets from, or create derivative works from any NVOX content, report format, sample report, platform output, website content, or proprietary material without prior written authorization from NVOX, except where expressly permitted by law.

No rights are granted to you except those expressly stated in these Terms.

11. User Feedback and Suggestions

If you provide comments, ideas, suggestions, feedback, or recommendations to NVOX, you agree that NVOX may use them without restriction or compensation, provided that NVOX handles any personal information in accordance with applicable privacy laws and applicable NVOX privacy documents.

Do not submit confidential, proprietary, or sensitive third party information through public website forms unless the form is specifically designed for that purpose and you have the legal authority to submit it.

12. Acceptable Use

You agree to use the website only for lawful purposes and in accordance with these Terms.

You must not attempt to gain unauthorized access to any NVOX system, account, database, network, or platform.

You must not interfere with the security, availability, integrity, or operation of the website or platform.

14. Pricing, Plans, Payments, and Promotions

The website may describe service pathways, pricing, discounts, coupons, promotional offers, clinician review models, turnaround expectations, or included services.

Prices, plans, included services, discounts, promotional offers, availability, clinician coverage, and turnaround estimates may change at any time unless otherwise expressly stated in writing.

A website description does not guarantee that a service will be available to every user or in every location.

Payment terms, refund terms, cancellation terms, no show terms, service pathway terms, clinician review terms, and report delivery terms are governed by the applicable checkout disclosures, Platform Terms of Use, and any additional terms presented at the time of purchase or enrollment.

15. Clinician Independence

Clinicians involved in the NVOX assessment process exercise independent professional judgment.

NVOX does not direct or control the independent clinical judgment of licensed professionals.

Information on the website about clinicians, clinician networks, clinical review, or professional involvement does not guarantee the availability of any particular clinician or any particular clinical conclusion.

Any separate professional engagement between a user and a clinician outside the structured NVOX service pathway is solely between the user and that professional, unless NVOX expressly states otherwise in writing.

16. NVOX Companion

The website may describe NVOX Companion or related support features.

NVOX Companion is an AI enabled informational and support feature. It is not a doctor, psychologist, psychiatrist, therapist, counselor, lawyer, school advocate, emergency service, or crisis service.

NVOX Companion does not provide diagnosis, treatment, medication recommendations, medication comparisons, medication changes, dosage instructions, legal advice, or emergency support.

Access to NVOX Companion may require separate acceptance of point of use notices and applicable Platform Terms of Use.

17. Website Availability and Changes

NVOX makes commercially reasonable efforts to maintain the website, but does not guarantee that the website will be uninterrupted, secure, current, error free, or available at all times.

NVOX may modify, suspend, discontinue, update, restrict, or remove any website feature, content, page, service description, form, or resource at any time.

NVOX may perform maintenance, security updates, compliance updates, content updates, technical changes, or operational changes without prior notice.

18. Disclaimers

To the maximum extent permitted by law, the website and all website content are provided on an “as is” and “as available” basis.

NVOX disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, completeness, availability, security, and uninterrupted operation.

No oral or written information provided by NVOX creates any warranty unless expressly stated in a written agreement signed by NVOX.

19. Limitation of Liability

To the fullest extent permitted by law, NVOX INC and its officers, directors, employees, contractors, affiliates, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, punitive, exemplary, or similar damages arising out of or relating to your use of the website.

This includes loss of data, loss of opportunity, loss of educational outcome, loss of employment outcome, loss of accommodation approval, reputational harm, business interruption, lost profits, emotional distress, reliance on website content, third party decisions, or inability to access the website.

To the fullest extent permitted by law, NVOX’s total aggregate liability arising out of or relating to the public website shall not exceed one hundred U.S. dollars, except where liability cannot be limited under applicable law.

If a claim arises from a paid platform service, the liability provisions in the applicable Platform Terms of Use will apply.

20. Indemnification

You agree to indemnify, defend, and hold harmless NVOX INC and its officers, directors, employees, contractors, affiliates, licensors, and service providers from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising out of or relating to your misuse of the website, your violation of these Terms, your submission of false or unauthorized information, your violation of another person’s rights, your unauthorized use of NVOX content or intellectual property, or third party reliance on information, content, reports, outputs, or materials that you share.

21. Dispute Resolution, Arbitration, and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the website shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, unless applicable law requires otherwise.

The arbitration shall take place in the State of Delaware, unless the parties agree otherwise in writing.

You and NVOX agree that disputes will be resolved only on an individual basis. You waive any right to participate in a class action, class arbitration, consolidated action, private attorney general action, or representative proceeding.

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for intellectual property infringement, unauthorized access, misuse of confidential information, data security threats, or misuse of the website or platform that may cause irreparable harm.

If any part of this arbitration provision is found unenforceable, the remaining parts will remain in effect to the fullest extent permitted by law.

22. Governing Law

These Terms are governed by the laws of the State of Delaware and the laws of the United States, without regard to conflict of law principles.

If any provision is restricted under applicable law, it will be applied to the maximum extent permitted, and the remaining provisions will remain enforceable.

NVOX is operated from the United States. The website may be accessible from outside the United States, but NVOX does not represent that all services, content, assessment pathways, or clinician reviewed workflows are available, appropriate, or legally permitted in every jurisdiction.

Users who access the website from outside the United States are responsible for complying with applicable local laws.

24. Export Compliance and Sanctions

You represent that you are not located in, organized under, or ordinarily resident in a country or territory subject to applicable United States embargoes or sanctions that would prohibit your use of the website or services.

You agree to comply with applicable export control, sanctions, and trade compliance laws.

25. Force Majeure

NVOX shall not be liable for delay or failure to perform resulting from events beyond its reasonable control, including natural disasters, war, terrorism, public health emergencies, labor disputes, infrastructure failures, cloud service outages, cyber incidents, payment processor outages, communications failures, governmental actions, or other events outside NVOX’s reasonable control.

26. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

27. Assignment

You may not assign or transfer your rights or obligations under these Terms without prior written consent from NVOX.

NVOX may assign or transfer its rights and obligations in connection with a merger, acquisition, financing, corporate restructuring, sale of assets, or similar transaction.

28. No Third Party Beneficiaries

These Terms are intended only for the benefit of you and NVOX INC.

Nothing in these Terms creates any rights or remedies for any third party.

29. Changes to These Terms

NVOX may update these Terms from time to time.

Material changes will be posted with an updated effective date. Continued use of the website after changes are posted means that you accept the updated Terms.

Where required by law or where NVOX determines that renewed acknowledgment is appropriate, NVOX may require renewed acceptance before continued access to certain website or platform features.
